1. Introduction

Welcome to findcargps.com, the online platform for purchasing GPS vehicle tracking devices and tracking service subscriptions. These General Terms and Conditions govern the use of our website, the purchase of products and services, as well as applicable warranties and returns. By placing an order, you agree to these terms. findCar, a registered trademark in the EU.

2. Placing Orders

2.1. Orders for products and services must be placed through our official website findcargps.com. 2.2. Upon completing your purchase, you will receive a confirmation email with the order reference number and a summary of the purchase. Keep this information as proof of the transaction. 2.3. We reserve the right to decline orders in case of errors in the information provided by the customer, suspected fraud, or product unavailability.

3. Prices and Taxes

3.1. All prices are indicated in Euros (€) and include the applicable VAT in the European Union, unless stated otherwise. 3.2. Shipping costs are included for deliveries to the Iberian Peninsula and the Balearic Islands. For the Canary Islands, Ceuta, Melilla, and other international destinations, additional costs will apply and be indicated during the purchase process. 3.3. We reserve the right to update prices and promotions at any time. Changes will not affect orders already confirmed.

4. Payment Methods

4.1. Payments can be made through:

  • Bank transfer.
4.2. Orders will be processed once payment is confirmed. We are not responsible for delays caused by payment verification.

5. Shipping Conditions

5.1. We deliver throughout Europe and the United Kingdom. 5.2. Delivery times:
  • Iberian Peninsula and Balearic Islands: 1-7 business days.
  • Canary Islands, Ceuta, and Melilla: 7-14 business days.
  • Rest of Europe and the UK: Estimated time provided during purchase, typically 5-7 days.
5.3. It is the customer’s responsibility to provide a complete and correct delivery address. We are not liable for delays or returns due to incorrect information provided by the customer. 5.4. In case of issues such as stock shortages or external delays, we will inform you and propose alternative solutions.

6. Right of Withdrawal and Returns

6.1. Right of withdrawal: Customers residing in the European Union have the right to withdraw from the purchase within 14 calendar days after receiving the order, without providing any justification. 6.2. To exercise the right of withdrawal:

  • For physical products: Return the product in its original packaging and in good condition. The shipping address is: GPS Consulting SL, Calle Secundino Zuazo 4, P9 1F, 28660 Boadilla (Madrid). Include the order number with the return.
  • The return shipping costs are the customer’s responsibility.
6.3. Returns for products damaged due to improper use or handling will not be accepted. Withdrawal of subscriptions: 6.4. You can cancel your first subscription within an extended period of 21 calendar days. 6.5. Subscription renewal requests are non-refundable.

7. Product Warranty

7.1. Products come with a two (2) year warranty from the delivery date, in accordance with applicable legal provisions. 7.2. The warranty covers manufacturing and material defects, excluding:
  • Damages caused by improper use, negligence, incorrect handling, or modifications.
  • Natural wear and tear or aging. Cosmetic damages such as scratches, impacts, and dents.
7.3. To request technical assistance under warranty:
  • Complete the assistance form available on our website.
  • Include the form along with the product and proof of purchase.

8. Terms of Subscription Services (“findCar Tracking Services”)

8.1. Subscriptions include the use of findCar’s web-based platforms and apps (Android, iOS), as well as data transmission through the SIM card included in the GPS for tracking services. The use of the SIM for other purposes will be monitored and penalized. 8.2. findCar subscriptions are exclusive to findCar GPS devices and are required for the proper functioning of these devices (“tracking service”). 8.3. Each GPS device requires a separate subscription to function properly. One subscription is valid for one device. Purchase as many subscriptions as the devices you wish to operate. 8.4. Subscriptions will automatically renew unless the customer cancels in advance via the customer portal or payment is declined. 8.5. Subscription cancellation must be communicated at least 2 days prior to the renewal date. 8.6. In the event of withdrawal during the first subscription within the extended period of 21 days, a proportional refund for unused days may be granted if fraudulent use is identified by findCar. 8.7. The provision of tracking services for subscribed devices depends on the availability of mobile networks in the GPS’s location and interconnection systems (Internet), which are beyond findCar’s control. Therefore, we cannot guarantee full availability. However, findCar will use its resources to ensure high-quality service.

9. Unlimited Replacement Warranty

If the customer contracts the “Unlimited Replacement Warranty” together with a GPS device subscription, this warranty provides an EXTENDED WARRANTY for the “findCar” GPS device, regardless of the acquisition channel: The tracking service subscriptions include an unlimited replacement warranty, which covers:
  • Replacement of the GPS device in case of defect, improper use, failure, or other incidents with the service.
  • Coverage of replacement costs: collection and shipping within the EU + UK.
  • Extension of the warranty beyond the legal two years.
  • The duration of this warranty will be extended as long as the subscription with the active unlimited warranty option remains active without interruptions.

10. Limitation of Liability

10.1. findCar will not be liable for:
  • Delays caused by third parties (suppliers or carriers).
  • Indirect or consequential damages resulting from the use of our products.
10.2. Our liability is limited to the amount paid for the products or services purchased.

11. Data Privacy and Security

11.1. The collection and processing of personal data comply with the GDPR and the UK Data Protection Act 2018. 11.2. For more details about the use of your data, consult our full Privacy Policy on our website.

12. Applicable Law and Dispute Resolution

12.1. These terms are subject to the laws of Spain and the European Union. For customers in the United Kingdom, the corresponding legislation will apply. 12.2. In case of disputes, the parties will attempt to resolve them amicably. If this is not possible, the dispute will be submitted to the courts of Madrid (Spain).
